De conformidad con lo dispuesto en la Ley de Servicios de la Sociedad de la Información y de Comercio electrónico, se facilita al usuario de la web de VINCCI HOTELES, que desee formalizar una reserva a través de la misma, con carácter previo al procedimiento de contratación, la siguiente información:

1.- La formalización de la reserva se llevará a cabo cumplimentando los campos del formulario de reserva on line, y pulsando el ratón sobre el link “continuar”. Realizado este click, la reserva quedará perfeccionada, recibiendo el usuario, en la dirección indicada en el formulario, un correo electrónico de confirmación con el número de su reserva en un plazo de 24 horas. En el caso de que el usuario hubiera formalizado con anterioridad una reserva on line no será necesario cumplimentar nuevamente el formulario, sino que será suficiente con introducir su dirección de correo electrónico y su contraseña en el apartado de huésped repetido, y hacer click en “someter”.

2.- VINCCI HOTELES archivará el documento electrónico en el que se formaliza la reserva con la finalidad de ejecutar la misma y prestar los servicios contratados en el Hotel seleccionado, pudiendo el usuario acceder a dicha reserva en la página web de VINCCI HOTELES utilizando la contraseña y dirección de e-mail indicadas al formalizar la reserva, con la finalidad de modificarla, cancelarla o revisar su historial de reservas.

3.- En caso de error en la introducción de los datos de la tarjeta de crédito el sistema avisará de ello inmediatamente, debiendo introducirse de nuevo correctamente para que la reserva se pueda formalizar. En caso de error en la introducción de otros datos, se podrá rectificar la reserva en los apartados de modificación de reservas y de perfil del huésped, a la que se podrá acceder utilizando la contraseña y correo electrónico utilizados en la formalización de la reserva.

4.- La cancelación de la reserva se podrá llevar a cabo on-line, en la página web de VINCCI HOTELES, utilizando la contraseña y dirección de e-mail indicadas en la reserva.

5.- La reserva se puede formalizar en castellano y en inglés, si bien VINCCI HOTELES, está estudiando en la actualidad la implementación de nuevos idiomas en su página web.”

CONDICIONES GENERALES

La formalización de una reserva en alguno de los establecimientos hoteleros de VINCCI HOTELES, se regirá por las siguientes condiciones generales.

1ª.- Las reservas se mantienen hasta las 18:00 p.m de la fecha de entrada, salvo que quede garantizada (T.Crédito o Bono Agencia).

2ª.- Las cancelaciones de las reservas deberán hacerse antes de las 12:00 pm del día anterior a la fecha de llegada al hotel.

3ª.- En el caso de no show (no presentación del cliente en la fecha de llegada al hotel según la reserva), VINCCI HOTELES tendrá derecho a cobrar una (1) noche de estancia con arreglo al precio pactado, mediante cargo a través de la tarjeta de crédito identificada en la reserva. Asimismo, VINCCI HOTELES se reserva el derecho a cargar en la tarjeta de crédito facilitada en la reserva los servicios consumidos por el cliente durante su estancia en el hotel que no hubieran sido abonados a su salida.

4ª.- VINCCI HOTELES no se hace responsable de los daños y perjuicios causados a sus clientes por una inadecuada utilización de sus instalaciones.

5ª.- El cliente se compromete a utilizar los servicios hosteleros contratados en virtud de la reserva, de conformidad con lo exigido por la ley, la moral, las buenas costumbres, el orden público y lo establecido en las presentes condiciones generales. En consecuencia, no podrá llevar a cabo en las habitaciones o dependencias reservadas actividades molestas, insalubres, peligrosas, inmorales o ilícitas, respondiendo de los daños y perjuicios que se puedan causar tanto a VINCCI HOTELES como a terceros en caso contrario.

6ª.- VINCCI HOTELES no responde de los daños y perjuicios de cualquier naturaleza que pueda sufrir el cliente como consecuencia de la presencia de virus u otros elementos o accesos no autorizados en los contenidos de su página web.

7ª.- Cualquier controversia o litigio en relación con la reserva se regirá por la Legislación Española y ante los tribunales de Madrid, con renuncia expresa a su fuero propio u otro que pudiera corresponderle por parte del cliente.

8ª.- La reserva formulada on-line, integrada por estas condiciones generales, constituye la expresión completa e íntegra del acuerdo entre VINCCI HOTELES y el cliente, sustituyendo a los anteriores pactos, compromisos o acuerdos que pudieran haber existido previamente, que quedan anulados y sin efecto alguno.”

1º) Protección de datos de carácter personal

A.- Formalización de reservas on-line

La cumplimentación de los datos personales solicitados en el formulario de Reservas Online es obligatoria, y se entiende como expresión inequívoca del consentimiento para su inclusión en la base de datos de VINCCI HOTELES, y su tratamiento automatizado para ejecutar el contrato de reserva. Tal consentimiento incluye la posibilidad de utilizar dichos datos para enviarle información sobre nuestros productos, servicios y actividades comerciales. Asimismo, se informa al cliente que sus datos personales serán cedidos a las empresas que tengan que intervenir en la gestión de la reserva, al hotel de destino, y a las empresas del grupo VINCCI HOTELES o terceros que tengan que intervenir en la prestación de los servicios contratados y con esta única finalidad, pudiendo producirse transferencias internaciones de datos con la misma finalidad de gestionar la reserva y garantizar la ejecución de la misma.

B.- Solicitud de empleo

Al cumplimentar y enviar la solicitud de empleo y el currículum vitae en la página web de VINCCI HOTELES, el interesado acepta y autoriza el tratamiento automatizado de sus datos de carácter personal y su introducción en la base de datos de VINCCI HOTELES, con la finalidad de llevar a cabo sus procesos de selección de personal, así como la cesión de los mismos a las empresas del grupo VINCCI HOTELES con dicha exclusiva finalidad.

C.- Ofertas en su e-mail

Al cumplimentar y enviar la solicitud de recibir información sobre las ofertas y promociones comerciales de VINCCI HOTELES en su e-mail, el interesado consiente expresamente la inclusión de sus datos en la base de datos de VINCCI HOTELES, y su tratamiento automatizado para enviarle información sobre nuestros productos, servicios y actividad comerciales.

D.- Derechos del titular de los datos de carácter personal.

Los titulares de los datos personales tratados por VINCCI HOTELES de conformidad con lo expuesto anteriormente, podrán ejercitar sus derechos de acceso, rectificación, cancelación y oposición dirigiéndose por escrito a VINCCI HOTELES, S.A., en su domicilio sito en c/ Anabel Segura nº 11, Edificio A-Bajo, Centro de Negocios Albatros, Arroyo de la Vega, 28108, Alcobendas, Madrid.

2º) Confidencialidad

VINCCI HOTELES garantiza la confidencialidad de los datos personales registrados en su bases de datos, cuyos ficheros están dados de alta en la Agencia de Protección de Datos, que sólo tendrán acceso a los mismos las personas encargadas de su tratamiento y que no se revelarán a ningún tercero salvo en los supuestos previstos anteriormente.

Asimismo, VINCCI HOTELES garantiza que los medios técnicos e informáticos con los que lleva a cabo el tratamiento de los datos personales cuenta con todas las medidas de seguridad exigidas por la Ley Orgánica 15/99, de 13 de diciembre, de Protección de Datos de Carácter Personal y sus normas de desarrollo. “

LEGAL INFORMATION REGARDING ON-LINE RESERVATIONS

Pursuant to the stipulations of the Information Society and Electronic Commerce Services Act, users of the VINCCI HOTELES web site who wish to make a reservation by means thereof, prior to the contracting procedure, are furnished with the following information:

1.- The reservation will be made by filling out each field of the on-line reservation form, and clicking the mouse on the link “continue”. Once this is done, the reservation will be complete, and within 24 hours the user will receive at the address indicated on the form an e-mail confirmation containing the user’s reservation number. In those cases where the user has made an on-line reservation in the past, it will not be necessary to fill out the form again; all the user need do is enter his/her e-mail address and password in the repeat guest section and click on “continue”.

2.- VINCCI HOTELES will file the electronic document in which the reservation is made in order to process it and provide the services contracted in the Hotel selected; the user can access this reservation on the VINCCI HOTELES web page by using the password and e-mail address indicated when the reservation was made, and in this way can make changes in the reservation, cancel it or review his/her reservation history.

3.- Should an error be made when entering credit card information, the system will immediately notify the user that the information is erroneous; in this case, the user will have to re-enter the information, this time corrected, in order for the reservation to be made. Should an error be made when entering other types of information, the reservation can be corrected in the sections on reservation changes and guest profile, which the user can access by using the password and e-mail address used when making the reservation.

4.- The reservation may be canceled on line, on the VINCCI HOTELES web page, using the password and e-mail address indicated in the reservation.

5.- The reservation can be made in Spanish and in English, and VINCCI HOTELES is currently studying the addition of new languages to its web page.”

GENERAL TERMS AND CONDITIONS

Reservations in one of the hotels belonging to VINCCI HOTELES shall be governed by the following general terms and conditions.

1.- The conditions, terms, dates and options entered and selected by the guest on the on-line reservation form, and the warnings or notes contained therein shall be deemed to be specific terms and conditions of the reservation agreement, which shall be governed, in all matters not provided for therein, by the stipulations of the present general terms and conditions. Furthermore, in the event of a contradiction between the stipulations of the form and those of the general terms and conditions herein, the provisions contained in the former shall apply.

2.- All reservation cancellations must be made prior to 48 hours in advance of the date of arrival at the hotel which is stated in the reservation, unless the on-line reservation form stipulates in any warnings or notes contained therein a longer cancellation period with respect to the guest’s reservation, in which case the latter shall be applicable.

3.- In the event of a no-show (failure of the guest to show up at the hotel on the date of arrival according to the reservation), VINCCI HOTELES shall be entitled to charge one (1) night’s stay in accordance with the price agreed to, unless any warnings or notes contained in the on-line reservation form stipulate a higher penalty in terms of the circumstances of the reservation selected, in which case the latter penalty shall be applicable. The no-show penalty shall be charged to the credit card identified in the reservation. Likewise, VINCCI HOTELES reserves the right to charge to the credit card furnished in the reservation any services consumed by the guest during his/her stay at the hotel which were not paid for upon the guest’s departure.

4.- VINCCI HOTELES shall not be held liable for any harm caused to its guests owing to improper usage of the facilities.

5.- The guest undertakes to use the hotel services contracted by virtue of the reservation in accordance with the requirements stipulated by law, morality, respectability, law and order, and the stipulations of the present general terms and conditions. Consequently, the guest may not engage in any bothersome, unhealthy, dangerous, immoral or illegal activities in the reserved rooms or premises of the hotel, or shall otherwise be held accountable for any damage caused to VINCCI HOTELES and/or to third parties.

6.- VINCCI HOTELES shall not be liable for any type of damage caused to the guest as the result of a virus or any other non-authorized element or access in the contents of its web page.

7.- Any dispute or litigation in relation to the reservation shall be governed by Spanish Legislation and settled before the courts of Madrid, with the guest expressly waiving his/her own jurisdiction or any other jurisdiction which may correspond to him/her.

8.- The on-line reservation, comprised of these general terms and conditions constitutes the complete and integral expression of the agreement between VINCCI HOTELES and the guest, and shall replace any prior pacts, commitments or agreements which may have existed heretofore and which hereby become null and void.

PRIVACY CLAUSE

1) Personal Data Protection

A.- When Making On-line Reservations

It is mandatory to fill in the personal information called for on the On-line Reservation Form, and by doing so the guest unequivocally gives his/her consent for this information to be included in the VINCCI HOTELES data base, and processed for the execution of the reservation agreement. Said consent includes the possibility of using said data to send the guest information on our products, services and commercial activities. Likewise, the guest is informed that his/her personal data will be released to companies required to take part in the managing the reservation, to the hotel of destination and to any companies of the VINCCI HOTELES group or third parties required to take part in providing the services contracted and that this shall be done solely for this purpose; international data transfer may occur for the same purpose of managing the reservation and ensuring that it is carried out.

B.- Employment Applications

When filling out and sending the employment application and curriculum vitae on the VINCCI HOTELES web page, the person concerned accepts and authorizes that his/her personal data be processed and entered into the VINCCI HOTELES data base for the purpose of recruiting staff, and likewise that said data be released exclusively for said purpose to the companies belonging to the VINCCI HOTELES group.

C.- Offers Sent by E-mail

When filling out and sending the request for information to be sent to his/her e-mail address in regard to offers and commercial promotions by VINCCI HOTELES, the party concerned gives his/her express consent to having his/her data included in the VINCCI HOTELES data base and processed for the purpose of sending him/her information on our products, services and commercial activities.

D.- Personal Data Titleholder Rights 

In accordance with the above, the titleholders to the personal data processed by VINCCI HOTELES may exercise their rights of access, rectification, cancellation and opposition by notifying VINCCI HOTELES, S.A. in writing at their registered offices located at c/ Anabel Segura nº 11, Edificio A-Bajo, Centro de Negocios Albatros, Arroyo de la Vega, 28108, Alcobendas, Madrid, Spain.

2) Confidentiality

VINCCI HOTELES guarantees the confidentiality of the personal data recorded in its databases, the files of which are registered with the Spanish Data Protection Agency, and that only those persons in charge of processing said data shall have access thereto, and furthermore that said data shall not be revealed to any third party except in those cases provided for above.

Likewise, VINCCI HOTELES guarantees that the technical and computerized means which it employs in processing personal data uses all of the security measures required by Spanish Act 15/99, of December 13^th, on Personal Data Protection and the Regulations developing said Act.”
